Terms and Conditions.

The agreement between you and Kiron Interactive (pty) Limited when you open an account and bet on this site. Please read it before you register.

Introduction and who we are

1.1 These Terms and Conditions ("Terms") are a contract between you and Kiron Interactive (pty) Limited, 1st Floor South Entrance, 26 Baker Street, Rosebank, Johannesburg, 2196, South Africa ("we", "us", "the operator"). We operate the website irishracingraceclubs.com ("the site"), which offers betting on horse racing in Ireland and Great Britain, virtual racing and pool betting.

1.2 Licensed and regulated in Great Britain by the Gambling Commission. Our Gambling Commission account number is 11572. We hold a General Betting Standard – Virtual Event Remote licence and a Pool Betting Remote licence, both numbered 011572-R-320611-010.

1.3 By registering an account, logging in or placing a bet you accept these Terms, the Privacy Policy, the Cookie Policy and the Betting Rules. The Betting Rules form part of these Terms. If a Betting Rule and a clause of these Terms conflict on the settlement of a specific bet, the Betting Rule applies.

1.4 To use the site you must:

  • be at least 18 years old;
  • be resident in the United Kingdom and use the site from within the United Kingdom;
  • register in your own name and hold only one account with us;
  • not be excluded from gambling through GAMSTOP or through a self-exclusion with us;
  • be legally able to enter into a binding contract.

1.5 Gambling by anyone under 18 is a criminal offence. If we find that a customer is under 18, the account is closed, all bets are void, winnings are withheld and deposits are returned after checks.

1.6 All balances, deposits, stakes and payouts on the site are in pounds sterling (GBP).

Registration and your account

2.1 When you register we ask for your first name, last name, date of birth, email address, a password, and your address, city and postcode. You must give accurate and complete details and keep them up to date through your account. We may not be able to verify you, and may not be able to pay a withdrawal, if the details on the account do not match your documents.

2.2 After you register we send a verification link to your email address. The link is valid for 24 hours. Your account is activated when you follow it; you can request a fresh link if it has expired.

2.3 We are required by our licence to verify your identity and age. Your verification status is shown in the account as Verification Required, Pending or Verified. You will be asked to upload a photo of an identity document (passport, driving licence or national identity card) and, where we need it, a proof of address. Withdrawals are available only when your status is Verified. We may ask for further documents at any time where we have a legal or regulatory reason to do so. Documents are kept in line with the retention rules in the Privacy Policy.

2.4 You are responsible for keeping your email login and password secret. Every action taken after a successful login using your credentials is treated as taken by you. Tell us at once at support@irishracingraceclubs.com if you think someone else knows your password or has used your account; we will suspend the account while we investigate. You can change your password at any time under Security in your account.

2.5 You may not transfer, sell or lend your account to anyone else, and you may not let anyone else use it. We may suspend or close an account in the circumstances set out in section 7; you may close your own account at any time from the Responsible Gambling section of your account.

Deposits and withdrawals

3.1 Deposits. You can deposit by Debit Card, Bank Transfer or E-wallet. The payment method must be in your own name; deposits from an account, card or wallet held by someone else are not accepted and, if identified, are returned to their source after checks. Card and e-wallet deposits are credited to your balance at once. A bank transfer is shown as pending until the funds reach us and is credited when they arrive.

3.2 The minimum deposit is £5 and the maximum is £5,000 per deposit. Any deposit limit you have set in your account, and any limit we apply, takes priority over these figures. Deposits are for betting on the site; the account is not a bank account and no interest is paid on a balance.

3.3 Withdrawals. The minimum withdrawal is £10. Withdrawals are paid back to a payment method in your name, and where possible to the method used to deposit. Each withdrawal request is reviewed before payment; the request is shown in your account as Pending, then Completed or Rejected. We do not promise a processing time. If a request is rejected we tell you why in the account or by email, and the amount is returned to your balance.

3.4 Before we pay a withdrawal we may check the source of your deposits, confirm your identity, and confirm that the request is consistent with our anti-money-laundering obligations. Funds deposited and withdrawn with little or no betting are returned to the original payment method.

3.5 Any charge we apply to a deposit or withdrawal is shown to you before you confirm it. Your bank, card issuer or e-wallet provider may apply their own charges, which are outside our control.

3.6 Your balance is shown in your account, and a record of every deposit, withdrawal, stake and payout is in your Transaction History. Customer funds are held in accounts separate from our business accounts. The Gambling Commission requires us to tell you the level of protection that applies to your funds if we became insolvent; we give you that statement before your first deposit and on request from support. Betting rules summary

4.1 This section summarises how bets work on the site. The full rules, including settlement examples, are on the Betting Rules page and take precedence over this summary.

4.2 Placing a bet. All bets are singles: one selection in one race. You can choose a Win bet, an Each-Way bet, or a Win Pool bet where the pool is offered. The stake is between £0.10 and £1,000 per bet. You may place only one selection per race in a single bet slip; to back more than one horse in a race, place separate bets.

4.3 Acceptance. A bet is accepted only if your balance covers the stake and the race is still open for betting. When you confirm the slip, the price is checked again. If it has moved since you added the selection, the bet is not placed; the slip shows the new price and asks you to place the bet again. A bet is placed only when it appears in My Bets with a bet reference; until then no contract exists.

4.4 Each-Way. An Each-Way bet is two bets of equal stake: one on the horse to win and one on it to be placed. The place part is paid at one quarter of the win odds. The number of places depends on the field size at the off: 8 or more runners, 3 places; 5 to 7 runners, 2 places; fewer than 5 runners, win only (the place stake is settled as a win bet at the win price).

4.5 Win Pool. In pool betting your stake goes into a pool with other customers' stakes. No fixed price is shown at placement. After the race the dividend is declared per £1 staked and your return is your stake multiplied by the dividend. The dividend depends on the total pool and the stakes on the winner; it is not known until the pool closes.

4.6 Settlement. Bets are settled from the official result of the race, normally within minutes of it being confirmed. Results are displayed on the Results page for the current and the previous day. If an official result is amended after settlement, affected bets are re-settled to the amended result, and the difference is added to or taken from your balance.

4.7 Non-runners. If your selection does not run, a Win or Each-Way bet is void and the stake is returned. A Win Pool stake on a non-runner is refunded.

4.8 Cancelled or abandoned races. If a race is cancelled, abandoned or declared void, all bets on it are void and stakes are returned.

4.9 Suspended markets. We may suspend a market at any time, for example while prices are being updated or where there is doubt about the race. No bets are accepted while a market is suspended. Bets accepted before suspension stand unless another rule voids them.

4.10 Virtual racing. Virtual races are computer-generated events. The result is produced by the game system's random number generator and is not connected to any real race, horse, jockey or course. Betting closes at the scheduled start time of the virtual race, and the result is usually available within about a minute. Virtual races are settled from the result recorded by the game system; there are no non-runners, stewards' enquiries or amended results in virtual racing.

4.11 Once a bet has been accepted it cannot be cancelled or changed by you. We may void a bet where these Terms or the Betting Rules allow it, including in the cases in section 9.

Prohibited conduct

5.1 You must not:

  • open or attempt to open more than one account, including in a different name or with different details;
  • deposit funds that are not your own, or use a payment method that is not in your name;
  • place bets on behalf of another person, or allow another person to bet through your account;
  • use the site if you are under 18, or help a person under 18 to use it;
  • use the site from outside the United Kingdom, or use a VPN, proxy or similar tool to hide your location;
  • use automated software, bots, scripts or data-scraping tools to access the site, place bets or collect prices;
  • take advantage of an obvious pricing, settlement or system error, or of any promotion or price in a way that is contrary to its purpose;
  • act together with other customers to exploit prices or promotions, or to bet against each other in a pool;
  • use information about a race that is not publicly available, or bet where you have a role that gives you inside knowledge of the race in breach of the rules of racing;
  • use the account to launder money or for any other unlawful purpose;
  • upload documents that are forged, altered or belong to someone else;
  • abuse or threaten our staff or other customers.

5.2 If we reasonably believe you have done any of these things, we may suspend the account, void the affected bets, withhold winnings that come from the conduct, return deposits after checks, and close the account. Where the law requires it we report the matter to the Gambling Commission, the sports governing body or law enforcement.

Responsible gambling

6.1 We are required, and we intend, to help you keep gambling within limits that you set. The tools below are in the Responsible Gambling section of your account and are described in full on the Responsible Gambling page.

  • Deposit limits — a cap on what you can deposit over a period. A lower limit applies immediately. A request to raise a limit takes effect only after a 7-day cooling-off period.
  • Time-out — 24 hours, 48 hours, 7 days, 30 days or 6 weeks. Betting and deposits are paused for the period; you can still log in to withdraw.
  • Self-exclusion — 6 months, 1 year or 5 years. Once set it cannot be shortened or cancelled. You are logged out, betting and deposits are blocked, marketing stops, and any balance is returned to you after the usual checks.
  • Account closure — permanent closure of the account.

6.2 You can exclude yourself from all gambling websites licensed in Great Britain through GAMSTOP. We check new registrations and existing customers against the GAMSTOP register; if you are registered, you will not be able to open or use an account with us for the length of your exclusion.

6.3 If you are worried about your gambling, free confidential support is available 24 hours a day from the National Gambling Helpline on 0808 8020 133 (England and Scotland) and the Gambling Helpline on 0808 2819 265 (Wales).

6.4 If we see signs that your gambling may be causing you harm, we may contact you, restrict the account or close it. This is a licence requirement, and we do it in your interest.

Suspension and closure

7.1 We may suspend your account, which stops betting, deposits and withdrawals while the suspension lasts, where:

  • we cannot verify your identity, age or address, or a document you supplied appears invalid;
  • we suspect a breach of section 5 or of the Betting Rules;
  • we suspect the account has been accessed by someone other than you;
  • a payment is disputed or charged back;
  • we are required to by the Gambling Commission, a court or another authority, or by anti-money-laundering rules;
  • we have concerns for your wellbeing under section 6.

7.2 We tell you the reason for a suspension unless the law prevents us from doing so, and we lift it when the reason is resolved. Where we close an account for a breach of these Terms, we may keep winnings that came from the breach; any remaining balance that is not affected by the breach is returned to you after checks.

7.3 We may also close an account with 14 days' notice by email where we stop offering the service, in which case the balance is paid to a verified payment method in your name.

7.4 When you close your own account, open bets are settled in the normal way and any balance is paid to you after verification. Closure is permanent; a closed account cannot be reopened.

Complaints and disputes

8.1 If you are unhappy with any part of our service, use the Complaints page (Submit Complaint). We ask for your account details, a description of the problem, the date it happened and, where relevant, the bet or transaction reference. The process has five stages: Complaint Registration, Review, Response, and, if you are not satisfied, Further Dispute Resolution.

8.2 We acknowledge the complaint, review it against your account records and these Terms, and give you a written response by email. We aim to resolve complaints within eight weeks of receiving them.

8.3 If you do not accept our final response, or eight weeks have passed without one, you may refer the dispute about the outcome of a gambling transaction to an independent alternative dispute resolution provider approved by the Gambling Commission. The service is free to you. We confirm the provider's name and contact details in writing when a complaint reaches that stage, and we give you the same details on request at any time.

8.4 Using the complaints process does not remove your right to take the matter to court. Records of bets and transactions held on our systems are the primary evidence in a dispute about a bet.

Liability and errors

9.1 Obvious errors. Where a price, a place term, a result or a settlement is obviously wrong — for example a price that is clearly out of line with the market, a pool dividend declared on the wrong result, or a settlement made from an unofficial result — we may correct it. Bets placed at an obviously incorrect price are void and the stake is returned; bets settled at an incorrect amount are re-settled at the correct amount, and the difference is added to or taken from your balance. If a correction leaves the balance below zero, we may recover the shortfall from your next deposit.

9.2 Where a system fault causes a bet to be accepted after the race has started, after the market was suspended, or against a balance that did not cover the stake, the bet is void and the stake returned.

9.3 We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything the law does not allow us to exclude. Nothing in these Terms affects your rights as a consumer under the law of England and Wales.

9.4 Subject to 9.3, we are not liable for loss that was not a foreseeable result of our breach of these Terms, or for loss caused by events outside our reasonable control, such as a failure of your internet connection, your device or a third-party payment provider. Where an official result is amended, bets are re-settled as described in section 4.

9.5 We may take the site offline for maintenance or to fix a fault. Bets accepted before an outage stand and are settled when the result is available. Race data and prices on the site are not advice; whether to bet, and how much, is your decision.

Changes to these terms

10.1 We may change these Terms where the law, our licence conditions or our service changes. Where a change is significant — for example a change to how bets are settled, to payment terms or to your rights — we tell you by email or by a notice when you log in, at least 14 days before it takes effect, unless the change is required by law sooner.

10.2 Minor changes, such as corrections or clearer wording, are made by updating this page. The date at the top of the page shows the version in force. Bets placed before a change are settled under the Terms and Betting Rules that applied when the bet was accepted.

10.3 If you do not agree with a change, you can stop using the site and close your account before it takes effect; any balance is returned to you after verification. Continuing to use the site after a change takes effect means you accept it.

Governing law and contact

11.1 These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute. If you live in Scotland or Northern Ireland, you may also bring proceedings in your own courts.

11.2 If any part of these Terms is found to be invalid or unenforceable, the rest continues to apply. If we do not enforce a clause on one occasion, we may still enforce it later.
